Welcome to MyMeditations. These Terms of Service ("Terms") govern your access to and use of the MyMeditations website, app, platform, content, tools, features, and services (collectively, the "Service"). MyMeditations is a service owned and operated by Ingage Digital Media ("Ingage Digital Media," "we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
If you are using the Service on behalf of a company, organization, or other entity, you represent and warrant that you have authority to bind that entity to these Terms.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and use the Service unless we expressly permit supervised use by minors through a parent, guardian, school, or other authorized entity.

MyMeditations may make some or all portions of the Service available on a beta, pilot, test, early-access, preview, or pre-release basis ("Beta Service").

Participation in a Beta Service may be provided without charge. Free beta participation does not create any right to continued free access, any particular future subscription price, or continued availability of any feature.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Platform Content solely within the Service and solely for your personal or otherwise authorized use in creating and listening to meditations through the Service.

MyMeditations is not a medical device and does not provide medical, mental health, psychiatric, therapeutic, legal, or other professional advice, diagnosis, or treatment.
Content created by users or made available through the Service should not be used as a substitute for advice, diagnosis, or treatment from a qualified professional.
You should consult an appropriate qualified professional regarding medical or mental health concerns. Never disregard professional advice or delay seeking it because of content made available through the Service.
If you believe you are experiencing a medical or mental health emergency, seek appropriate emergency assistance immediately.
We are not obligated to monitor User Content, but we may do so.

You may not use our names, logos, trademarks, or branding without prior written permission.
If you provide suggestions, ideas, comments, test results, bug reports, feedback, or recommendations regarding the Service ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, sublicensable right to use, modify, implement, incorporate, and exploit that Feedback for any lawful purpose without compensation or attribution to you.
Some or all Beta Services may be offered without charge. Other versions, plans, features, or services may now or in the future require payment, a subscription, or usage-based fees.

Features, functionality, technical requirements, storage limits, creation limits, streaming limits, and other aspects of the Service may change over time.
We may update, modify, restrict, suspend, or discontinue any portion of the Service as permitted by law.
You understand that digital services may experience downtime, bugs, delays, failures, data loss, and technical limitations.

MYMEDITATIONS AND INGAGE DIGITAL MEDIA DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We reserve the right to terminate accounts of users who repeatedly infringe intellectual property rights or repeatedly violate these Terms.
We may also restrict, suspend, or terminate access for users who abuse platform tools, harass others, misuse sharing features, attempt to circumvent technical protections, or create legal, safety, or security risks.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except to the extent applicable law requires otherwise.
Before filing a claim arising out of or relating to these Terms or the Service, you agree to first contact us at info@ingagedigitalmedia.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days, except where applicable law permits a claim to proceed without such a process.
Unless otherwise required by applicable law, any legal action arising out of or relating to these Terms or the Service shall be brought in an appropriate state or federal court serving Nevada County, California, and each party consents to personal jurisdiction and venue in those courts.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, COORDINATED, OR REPRESENTATIVE PROCEEDING.
Nothing in this section limits any right that cannot lawfully be waived.
By creating an account and using the Service, you consent to receive electronic communications from us relating to the Service or your account, including notices, disclosures, security communications, updates, receipts, subscription information, and transactional communications.
You agree that electronic communications may satisfy legal requirements that communications be provided in writing, to the extent permitted by applicable law.
Marketing or promotional communications will be handled separately where applicable and may be subject to separate consent and opt-out rights.
We may update these Terms from time to time.
If we make material changes, we may provide notice through the Service, by email, or through another reasonable method.
Where required by applicable law, we will obtain consent to revised Terms rather than relying solely on continued use.
The effective date of the current Terms will appear at the top of this document.
These Terms constitute the agreement between you and MyMeditations regarding the Service and supersede prior or contemporaneous understandings concerning the subject matter covered by these Terms.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
Our failure to enforce a provision is not a waiver of our right to enforce it later.
You may not assign or transfer these Terms or your rights under them without our prior written consent.
We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, financing, or by operation of law.
Headings are for convenience only and do not affect interpretation.
Nothing in these Terms waives any consumer right or remedy that cannot lawfully be waived.
